Seller Disclosures
In the interest of transparency, the following disclosures are provided to help potential buyers understand how properties are offered for sale through Titan Land–operated websites. Anyone considering a purchase is encouraged to read this information carefully before proceeding.
Ownership & How Properties Are Sold
Titan Land is not acting as a real estate broker or agent for the property owner. Properties and property interests marketed through Titan Land–operated websites generally fall into one of two categories:
Seller-Owned Property: The selling entity holds legal title to the property and is offering the property For Sale By Owner (FSBO).
Contract/Equitable Interest: An affiliated Titan Land entity has entered into a purchase agreement with the property owner and holds a contractual or equitable interest in the property. In these transactions, the entity does not yet hold legal title and is offering its contractual/equitable interest for assignment or other lawful disposition. The property remains titled in the current record owner’s name until closing.
The applicable ownership or contractual-interest status will be disclosed for the individual property and in the purchase documents. Titan Land does not represent the property owner or buyer as a real estate broker or agent.
As-Is Sale & Buyer Responsibility
All properties are sold AS-IS, WHERE-IS, with all faults. Seller makes no representations or warranties, express or implied, regarding access, utilities, zoning, buildability, soil conditions, water availability, topography, or suitability for any particular use.
Land is inherently variable, and conditions may change over time. Buyers are encouraged to perform whatever due diligence they deem appropriate prior to purchase, including visiting the property, reviewing public records, and contacting relevant county or state authorities.
Title, Liens & Conveyance
Properties are conveyed free and clear of recorded liens and encumbrances at the time of conveyance, subject only to matters of record (such as easements, rights-of-way, or subdivision plats).
In some cases, a property may have outstanding property taxes or recorded tax liens at the time it is listed for sale. Any such recorded taxes or liens will be satisfied and released by Seller prior to or at the time of deed transfer, unless expressly stated otherwise in writing.
Depending on how a property was acquired, title may be conveyed by Warranty Deed, Special Warranty Deed, or Quitclaim Deed, as disclosed on the individual property listing page and/or in the purchase documents. Title insurance is not provided unless expressly stated in writing.
Property Taxes
Seller will pay property taxes that have been assessed and billed for periods prior to deed transfer. All future property taxes are the responsibility of the buyer, whether or not the buyer receives a tax notice from the county.
Mineral Rights (Important)
Unless expressly stated on the individual listing page or in the purchase documents, mineral rights are not included with the property.
In many rural areas, mineral rights were reserved or severed decades ago by original developers, prior owners, or oil and gas interests—often long before our acquisition of the land. In most cases, there are simply no mineral rights remaining for a seller to retain or “strip” from the property. This is common throughout the western and southern United States and is not unique to properties offered here.
If mineral rights are included with a specific property, that will be clearly stated on the listing page and in the purchase documents.
Surveys, Boundaries & GPS Coordinates
Unless otherwise stated, properties sold have not been surveyed by Seller. Some parcels may have existing markers or fencing from prior surveys, but this is not guaranteed.
Any GPS coordinates provided are approximate and are intended only as a general reference to help locate the property. Buyers intending to build, fence, or otherwise improve the land are encouraged to obtain a professional survey after purchase.
Zoning, Restrictions & Permitted Use
Properties may be subject to county zoning ordinances, state or local building codes, environmental regulations, or subdivision covenants created when the land was originally subdivided.
While we make reasonable efforts to provide helpful information, zoning and land-use regulations can change, and interpretations may vary. Buyers are encouraged to independently verify permitted uses with the appropriate authorities prior to purchase.
Photos, Video & Property Information
Unless otherwise stated, photographs and videos provided on listing pages are of the subject property or its immediate vicinity and are intended for general informational purposes. Property descriptions, maps, and data are compiled from public records and third-party sources believed to be reliable but cannot be guaranteed.
Due Diligence & Final Terms
Due diligence is the buyer’s responsibility, and all sales are final except as expressly provided in the purchase documents.
The Land Contract, Promissory Note (if applicable), and related purchase documents contain the full terms of each transaction, including disclosures, buyer acknowledgments, conveyance type, payment terms, and default provisions. Buyers should review all documents carefully before completing a purchase.
